What is the case about?
On April 21, 2016, we filed Grayer v. Kennametal, 1:16-cv-1382 (N.D. Ohio), a collective and class action alleging that Defendant failed to pay manufacturing employees for 20 minutes of work they were required to perform before their shift each day.
What does the settlement provide?
The parties reached a settlement of the case and filed a Motion for Approval on November 11, 2019, which can be obtained here. Motion for Approval. On November 27, 2019, the Court granted preliminary approval of the settlement.
Kennametal's Settlement Payment of $1,812,500, after deductions, will be divided proportionally into Individual Payments for which the Representative Plaintiffs, Existing Opt-In Party Plaintiffs, Eligible Settlement Participants, and Class Members are eligible.
Is the settlement fair and reasonable?
Employees who participate in the Settlement will receive approximately 73.55% of the overtime compensation they were allegedly denied between January 2014 through June 2016.
Am I part of the class?
The class consisted of current and former hourly employees of Kennametal who worked at Kennametal's facility in Orwell, Ohio between January 2014 and June 2016 and who were subject to a "shift overlap" or early start work schedule and who did not opt-out of the Rule 23 Class Action.
