What is the case about?
On July 28, 2017, we filed this collective action on behalf of the welders ("Plaintiffs") of MAC Trailer ("Defendant").
Plaintiffs alleged that Defendant violated the Fair Labor Standards Act by failing to pay them for work performed between their scheduled start and stop times, and for the following work performed before their scheduled start time and after their scheduled stop time: a) changing into and out of personal protective equipment, including but not limited to gloves, welding jackets, helmets, boots, safety glasses, and/or flame retardant clothing; b) obtaining and putting away tools necessary to perform their job, including but not limited to hand tools, air tools, drills, grinders, saws, and/or welding wire; c) logging into MAC Trailer's computer systems to obtain his jobs; d) performing production work; e) cleaning up their production area; and f) walking to and from their assigned area of the production floor.
Plaintiffs believe that they are entitled to recover from Defendant unpaid overtime compensation, liquidated damages, attorneys' fees and costs.

Plaintiffs seek to sue on behalf of all of Defendant's welders within the last three years.

It is important that you return the Consent Form as soon as possible because the time period for which you can seek a payment for your unpaid wages will depend on when this form is filed with the Court.
What about retaliation?
The law prohibits Defendant, or any of its agents or employees, to discharge, or in any manner harass, discriminate or retaliate against you for taking part in this action.
Do I have to pay anything?
You do not have to pay anything to our firm if you join the action. We are handling this case on a contingency basis. This means we will only be paid if the action is successful in obtaining a recovery Plaintiffs, and that payment will only come out of that recovery.
