What is the case about?
On October 28, 2016, we filed a collective action against Defendant American Sugar Refining in the U.S. District Court for the Northern District of Ohio for a class of production employees who seek unpaid overtime compensation.
The action alleges that Defendant violated the Fair Labor Standards Act by failing to pay production employees for work that they performed before and after their scheduled start and stop times, including time spent donning a smock, hair net, safety glasses, beard guard, gloves, and/or hearing protection, washing hands, attending pre-shift meetings, walking to their assigned areas, walking from their assigned areas, and doffing their smock, hair net, safety glasses, beard guard, gloves, and/or hearing protection.
Plaintiffs believe that they and other employees are entitled to recover from Defendant unpaid overtime compensation, liquidated damages, attorneys' fees and costs.
Am I part of the class?
Plaintiffs seek to sue on behalf of themselves and the other current and former production employees who seek unpaid overtime compensation of Defendant within the last three years.

What about retaliation?
The law prohibits Defendant, or any of its agents or employees, to discharge, or in any manner harass, discriminate or retaliate against you for taking part in this action.
Do I have to pay anything?
You do not have to pay anything to our firm if you join the action. We are handling this case on a contingency basis. This means we will only be paid if the action is successful in obtaining a recovery for you, and that payment will only come out of that recovery.
