Hannah, et al. v. H.A.D., Inc.

What is the case about?
On June 27, 2014, we filed a collective action against Defendant H.A.D., Inc. on behalf of the named Plaintiffs Jeremy Hannah and Kip Green and all other similarly-situated individuals in the United States District Court for the Southern District of Ohio.

The action alleged that H.A.D. violated the Fair Labor Standards Act by failing to pay overtime compensation to oil and gas employees who were paid on a day-rate basis.

What does the settlement provide?
The parties reached a settlement of the case and filed a Motion for Approval on February 8, 2015, which can be obtained here. Motion for Approval. On March 2, 2016, the Court approved the settlement. H.A.D.'s Settlement Payment of $1,250,000.00 after deductions, was divided proportionally into Individual Payments for which the Representative Plaintiffs, 25 Existing Opt-In Party Plaintiffs, and 104 Eligible Settlement Participants were eligible to receive.

Is the settlement fair and reasonable?
Employees who joined the Settlement received approximately 90% of their alleged overtime damages during the three-year period of May 21, 2012 to May 22, 2015.

Am I part of the class?
The class consisted of all current and former non-exempt employees of H.A.D. who were paid on what H.A.D. referred to as a day-rate basis and allegedly were not paid overtime compensation for hours worked over forty (40) in one or more workweeks between May 21, 2012 and May 22, 2015.
