McPherson v. Horseshoe Casino Cleveland

What is the case about?
On November 7, 2014, we filed McPherson v. Horseshoe Cleveland Management, LLC d/b/a Horseshoe Casino Cleveland, No. 1:14-cv-02475 (N.D. Ohio), a collective and class action alleging that Defendant improperly classified table games supervisors as exempt from the overtime laws.

On January 20, 2016, we filed Alvarez v. Horseshoe Cleveland Management, LLC d/b/a Horseshoe Casino Cleveland, No. 1:16-cv-00138 (N.D. Ohio), bringing the same claims as in McPherson, but on behalf of poker supervisors.

What does the settlement provide?
The parties reached a settlement of both the McPherson and Alvarez cases, which were consolidated for the purpose of approving the settlement. On August 26, 2016, the parties filed a Motion for Preliminary Approval, which can be obtained here. Motion for Approval.

On September 2, 2016, the Court granted preliminary approval of the settlement, which provides for a maximum settlement amount of $900,000. The preliminary approval order can be obtained here. Preliminary Approval Order.

On December 14, 2016, the Court granted final approval of the settlement. The final approval order can be obtained here. Final Approval Order. Checks were issued by the settlement administrator in mid-February 2017.

Am I part of the class?
The approved classes consisted of all current and former (1) table games supervisors employed by Defendant at any time between January 1, 2012 and the date the Court entered an order preliminarily approving the settlement, and (2) poker supervisors employed by Defendant at any time between January 20, 2013 and the date the Court entered an order preliminarily approving the settlement.
