Jackson v. Maui Sands Resort

What is the case about?
On December 19, 2008, an action was filed against Defendants Maui Sands Resorts, Inc., Maui Sands Resort Company, LLC, E. Scott Emerson, Brighton Manor Company, Brighton Hotel Corp., and Mueller Electric Company (collectively “Maui Sands Resort”) on behalf of the named Plaintiff Brian Jackson and all other similarly-situated individuals in the United States District Court for the Northern District of Ohio.

Plaintiff was employed by Maui Sands Resort as an hourly, non-exempt employee. The action alleges that Maui Sands Resort violated the Fair Labor Standards Act by failing to pay Plaintiff and other similarly-situated employees for the last several weeks Maui Sands Resort was in business and for meal periods in which Plaintiff and other similarly-situated employees performed work.

Plaintiff believes that he and all other similarly-situated individuals are entitled to recover from Maui Sands Resort unpaid wages and overtime compensation, liquidated damages, attorneys’ fees and costs.

Am I part of the class?
Plaintiff seeks to sue on behalf of himself and also on behalf of other employees with whom he is similarly situated. Plaintiff alleges that those individuals consist of current and former hourly, non-exempt employees of Maui Sands Resort within the last three years.

How do I get involved?
The time period for joining this action has expired. If you fit the class definition, however, your claims may not have not expired.

What about retaliation?
The law prohibits Maui Sands Resort, or any of its agents or employees, to discharge, or in any manner harass, discriminate or retaliate against you for taking part in this action. If you believe that you have been retaliated against for participating in this action, contact us immediately. You may be able to assert additional claims against Maui Sands Resort.

Do I have to pay anything?
You do not have to pay anything to our firm if you join the action. We are handling this case on a contingency basis. This means we will only be paid if the action is successful in obtaining a recovery for you, and that payment will only come out of that recovery.
