Dillworth v. Case Farms Processing
What is the case about?
On July 15, 2008, an action was filed against Defendant Case Farms Processing ("Case Farms") and on behalf of the named Plaintiff Gentry Dillworth and all other similarly-situated individuals in the United States District Court for the Northern District of Ohio, Case No. 1:08-cv-1694.
Plaintiff was employed by Case Farms as a poultry processor. The action alleges that Case Farms violated the Fair Labor Standards Act by failing to pay Plaintiff and other similarly-situated poultry processors for: 1) time spent changing into and out of their uniforms, hair coverings, and applicable personal protective equipment at work; and 2) time spent walking to and from the production floor after and before changing.
Plaintiff believes that he and all other similarly-situated individuals are entitled to recover from Case Farms unpaid wages and overtime compensation, liquidated damages, attorneys’ fees and costs.
Am I part of the class?
Plaintiff seeks to sue on behalf of himself and also on behalf of other employees with whom he is similarly situated. Plaintiff alleges that those individuals consist of current and former poultry processors of Case Farms nationwide, at any time within the last three years. This includes Case Farms' facilities in Winesburg, Ohio, and Goldsboro and Morganton, North Carolina.
